The lawsuit, filed in October, targets the chain sandwich shop.

It says Subway and a number of its partners were negligent in dealing with reports regarding Fogle's inappropriate activities with underage girls.

Kathleen McLaughlin, who was married to Fogle from 2010-15, is seeking unspecified monetary damages from Doctor’s Associates, Inc., doing business as Subway; Franchise World Headquarters LLC.; and Subway Franchisee Advertising Fund Trust.

Fogle — who came to fame and fortune after losing more than 200 pounds as a college student eating a diet heavy on Subway sandwiches — plead guilty in 2015 to possessing child porn and traveling to pay for sex with minors.  He was sentenced to 15 years in prison.

The lawsuit claims the sub shop did not have permission to use the ex-wife's likeness or those of the couple's children in an advertising campaign promoting Fogle as a family man.
