Lawyer That Led Marijuana Amendment Push Sues State Over Smoking Ban

A Leon County judge is being asked to weigh in on the state's new medical marijuana law.

Advocate and lawyer John Morgan filed a suit Thursday morning claiming state lawmakers and the Governor ignored voters' wishes when they approved legislation which excludes smoking cannabis for "medical use." He tweeted that the suit was being filed on behalf of "citizens and patients" in the state.

The state legislature did not write smoking into bills that were passed during a June special session implementing Amendment 2, which passed last year – only allowing for vaping and the use of certain oils and lotions.

Morgan says the provision "redefined and narrowed the definition of marijuana in direct conflict" with the Constitutional amendment.

Morgan led the push to get a medical marijuana amendment passed during the 2016 election, and got the amendment passed with a 71 percent of the vote.
